Rhode Island Social Security Claims (SSI / SSDI) Lawyers
Social Security Claims are often a source of frustration and confusion. People who apply for Social Security Disability face mountains of paperwork and a tough application process that results in denial in more than half of all cases. However, if you have a disability that prevents you from earning a living, you shouldn't let the process prevent you from filing for benefits you are entitled to receive.
Understanding the Social Security Administration (SSA) system – and working with an experienced attorney can help navigate the complex road of disability claims. Contact the lawyers at Gemma Law Associates, Inc. at 401-467-2300 or submit an online contact form for help with your claim.
There are four primary types of Social Security claims:
- Social Security Disability Insurance (SSDI) provides financial benefits to people who have previously worked five out of the last 10 years but have become disabled to such an extent they can no longer work.
- Disabled Widow's and Widower's Benefits provide financial benefits to widows or widowers who have become disabled within a certain amount of time after the death of their spouse. These benefits, like SSDI, require that the recipient has worked in the past and contributed to the Social Security program.
- Disabled Adult Child Benefits provide financial support to children who become disabled before the age of 22, and whose parents are either deceased or receiving retirement or Social Security Disability payments.
- Supplemental Security Income (SSI) is different from the first three types; instead of taking into account past work contributions to the Social Security system, SSI looks at the income of the claimant. SSI is available for both disabled children and adults, although the requirements are different for each group.
What all of these benefits have in common is a stringent review process and frequent denial of first-time applicants. Up to 70% of all claims are initially rejected. The rejections include applicants with very obvious disabilities and financial needs.
If your claim is turned down, you can request what is known as "reconsideration" – which means your claim will be reviewed again. At this stage, consulting with an attorney familiar with the SSA process can be vital – and can make a real difference in the successful outcome of your claim.
